Prosecutors in Utah have filed a forceful response urging a judge to uphold all charges, including the death penalty, against Tyler James Robinson, the 23 year old man accused of assassinating conservative activist Charlie Kirk. In a 19 page filing submitted to Utah County’s Fourth District Court on August 18, prosecutors rebutted defense arguments that evidence presented during a preliminary hearing failed to meet legal standards necessary for the case to proceed to trial.
Robinson stands accused of fatally ing Kirk in the neck on September 10, 2025, as Kirk addressed a crowd of approximately 3,000 people in a courtyard at Utah Valley University in Orem. Defense attorneys had argued that prosecutors failed to elish probable cause or demonstrate that the ing created a high probability of endangering others beyond Kirk himself, a requirement for the death penalty charge under Utah law.
Prosecutors countered that defense lawyers ignored critical evidence while misconstruing legal standards. They emphasized that numerous attendees were in the line of fire or within the zone of danger during the ing, clearly elishing the aggravating circumstances necessary to support capital charges. Evidence presented shows that a gunman crawled to a sniper’s perch, fired the fatal shot, hid the rifle in a wooded area, disposed of clothing, and instructed a roommate to delete text messages about the ing.
Robinson’s defense team has not challenged evidence linking their client to these actions. The case now awaits judicial determination on whether sufficient probable cause exists to proceed to trial, with the death penalty remaining on the table as prosecutors prepare their case against the accused assassin.
