The Coalition Political Action Committee COPAC has called on the Federal Government of Nigeria to either formally charge former Kaduna State governor Nasir El Rufai in court or release him without further delay. The coalition warned that keeping him in detention beyond the period allowed by law would violate the Nigerian Constitution and international human rights principles.
COPAC made this known on Sunday in Abuja through its convener Aminu Datti Ahmed. According to the group the rule of law must always be respected and should not be suspended for political convenience or partisan interests.
Nasir El Rufai reportedly honoured an invitation from the Economic and Financial Crimes Commission on February 16 in connection with allegations of financial misconduct. He remained in the custody of the anti corruption agency until February 18 when he was later transferred to the Independent Corrupt Practices Commission for additional investigation.
Since that time the former governor has continued to remain in detention.
COPAC explained that investigative detention under Nigerian law is temporary and must lead to either a formal charge before a competent court or the immediate release of the individual involved. The coalition pointed out that the 14 day remand order previously obtained by investigators has already expired.
The group stressed that such a remand order is meant to give investigators limited time to complete their work within the boundaries of the constitution. It added that the order should not be used as justification for indefinite detention or political drama.
COPAC also referenced Section 35 of the Constitution which protects the liberty of every Nigerian citizen. The coalition warned that any continued detention without proper legal process would amount to an abuse of state power.
The organisation further urged opposition figures and democratic actors across the country to speak out against any actions that could undermine the rule of law in Nigeria.
