A British Australian pianist has lost his legal battle against the Melbourne Symphony Orchestra after suing for discrimination over comments he made about Gaza during a performance. Jayson Gillham, 39, had filed the lawsuit following the cancellation of his scheduled August 2024 concert, which came just days after he dedicated a performance to Palestinian journalists ed in the conflict and spoke about war crimes from the orchestra’s stage.
Federal Court Justice Graeme Hill ruled on Friday that the orchestra acted legitimately to protect its business interests, finding that workplace protections did not extend to Gillham due to his status as an independent contractor. The decision centered on who controls the orchestra’s platform and whether performers can make unsolicited political statements during concerts. Justice Hill determined that the cancellation was not motivated by political beliefs but rather by concerns about anticipated adverse impacts on the orchestra’s business and reputation.
The controversy began on August 11, 2024, when Gillham performed a short piece called Witness, composed by multimedia artist Connor D’Netto. He told the aunce that more than 100 Palestinian journalists had been ed in the conflict and stated that targeting journalists in warfare constitutes a war crime under international law. Four days later, the Melbourne Symphony Orchestra cancelled his upcoming performance scheduled for August 15, notifying patrons that Gillham had made personal remarks without seeking approval or sanction from the organization.
Justice Hill found that the orchestra maintained a clear policy of not expressing support for either side of the Israel Gaza conflict. The court also recognized an elished custom within classical music that performers do not make statements on sensitive political or social issues from the stage without approval from the host organization. Gillham’s barrister, Sheryn Omeri KC, had argued that the contract did not prevent the pianist from making such statements and suggested he would not have been cancelled if he had called for the release of Israeli hostages instead, noting that the orchestra’s then managing director had done exactly that in December 2023.
Chair Edgar Myer welcomed the judgment and praised the dedication and professionalism of the orchestra’s musicians and staff who worked despite the disruption and distraction of defending the legal proceedings. The organization emphasized that the fundamental issue was control of its stage and maintained that Gillham should have sought authorization before making his statements. Following the cancellation, the orchestra received just three complaints about Gillham’s remarks but 487 complaints objecting to the decision to cancel his performance, revealing significant public backlash against the organization’s response.
Michael Bradley, Gillham’s lawyer, told Australian Broadcasting News that his client, currently in the United Kingdom, is obviously very disappointed with the outcome and that the legal team will need time to review the judgment and understand its full implications. The case raises broader questions about artistic freedom, political speech, and the boundaries of performer autonomy in institutional settings.
