During an appearance on BBC Breakfast, Alexander faced pointed questions about whether two men jailed in connection with the death of PC Andrew Harper will qualify for early release under Labour’s emergency plans to address severe overcrowding in the prison system. The transport secretary notably declined to provide a definitive answer about the eligibility of the two passengers, though she confirmed that the driver responsible for the fatal incident would not benefit from automatic release provisions.
PC Harper sustained fatal injuries in August 2019 while responding to reports of a quad bike theft in Sulhamstead, Berkshire. The 28 year old officer became caught in a strap attached to the rear of a fleeing vehicle and was dragged along a country road as three teenage suspects attempted to escape the scene. His death shocked the nation and sparked widespread debate about sentencing for crimes against emergency service workers.
Alexander emphasized the horrific nature of the crime while attempting to explain the nuances of the government’s sentencing policy. She noted that three individuals were in the vehicle at the time of the incident, with the driver receiving a substantially longer sentence than his two passengers. While the driver has been explicitly barred from the revised sentencing arrangements and must appear before a parole board before any potential release, the two passengers could potentially be released at the halfway point of their sentences under the new framework.
Defending the broader policy decision, the transport secretary argued that ministers were forced to make “difficult but necessary decisions” upon taking office. Alexander revealed that when Labour entered government in the summer of 2024, the prison system was on the brink of collapse, with approximately 100 spaces remaining across the entire estate. She placed responsibility for the crisis squarely on the previous Conservative administration, citing their failure to commission and construct the additional prison capacity the country requires.
