Nigerian President Tinubu Seeks Extension in US Drug Trafficking Records Lawsuit

Nigerian President Bola Tinubu has formally joined the United States Department of Justice in requesting additional time to respond to a court order demanding the release of records related to decades-old drug trafficking allegations. The request, filed through his legal counsel Christopher Carmichael at the US District Court, seeks a ten-day extension to address a motion for summary judgment in the ongoing Freedom of Information Act litigation.

The case centers on FOIA requests filed by Aaron Greenspan, founder of PlainSite, who sought records from multiple federal agencies regarding a Chicago trafficking ring investigation from the early 1990s. Judge Beryl Howell previously ruled that the FBI and DEA must release relevant documents after finding their refusal to confirm or deny the existence of such records was improper. However, the judge granted only a four-day extension rather than the requested ten days, noting the case has already been pending for over three years.

The legal controversy stems from Tinubu’s 1993 forfeiture of $460,000 to the US government in proceedings linked to trafficking allegations. This issue surfaced prominently during Nigeria’s 2023 presidential election, when opposition candidates argued the forfeiture should have disqualified Tinubu from office. The Presidential Election Petition Court ultimately ruled that petitioners failed to prove criminal conviction, determining the forfeiture was civil rather than criminal in nature.

As the August 21 deadline approaches, the case continues to draw international attention, potentially affecting diplomatic relations between the United States and Nigeria while raising questions about transparency and accountability in both nations’ political systems.
